1. About this policy

This website and its related activities operate under the registered trading name Fenrow (Fenrow, we, us or our). This policy explains how we collect, hold, use and disclose personal information. We aim to handle personal information consistently with the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us.

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

2. Information we collect

Depending on how you deal with us, we may collect:

  • contact details such as your name, business email address, telephone number and location;
  • professional information such as your organisation, role, crops, production formats, fertiliser program and areas of interest;
  • enquiries, correspondence, meeting notes and feedback;
  • trial and commercial relationship information, including site contacts, observations, results and supporting records;
  • supplier, contractor, research collaborator and job applicant information;
  • website information such as IP address, device and browser type, pages viewed, referral source and approximate location; and
  • any other information you choose to give us.

Please do not send us sensitive information unless it is genuinely necessary and we have agreed to receive it.

3. How we collect information

We usually collect information directly from you through our website form, email, telephone, meetings, events, trials, contracts and other business interactions. We may also receive business contact information from your organisation, a professional adviser, a referral partner, publicly available sources or a collaborator where it is lawful and reasonable to do so.

Our website and hosting providers may automatically collect technical information through server logs, cookies or similar technologies. You can control cookies through your browser, although disabling them may affect some website functions.

4. Why we use personal information

We may use personal information to:

  • respond to enquiries and arrange discussions, quotations, trials or partnerships;
  • design, administer, document and evaluate product trials;
  • provide products, services, technical information and customer support;
  • manage suppliers, contractors, collaborators and commercial relationships;
  • improve our website, products, research and business operations;
  • send relevant business updates where you have consented or where otherwise permitted by law;
  • protect our systems, investigate misuse and maintain safety and security; and
  • meet legal, regulatory, insurance, audit and record-keeping obligations.

5. Disclosure

Where reasonably necessary, we may disclose personal information to:

  • technology, cloud hosting, email, analytics and security providers;
  • professional advisers, insurers, auditors and financiers;
  • research institutions, laboratories, trial partners, agronomists, manufacturers, logistics providers and distributors involved in the relevant work;
  • regulators, courts, law enforcement or other persons where required or authorised by law; and
  • a purchaser or adviser in connection with a proposed restructure, investment or sale of all or part of our business.

We do not sell personal information. Where possible, trial and research information used for analysis or publication will be aggregated or de-identified unless identification has been agreed or is required.

6. Overseas handling

Some service providers or their infrastructure may be located outside Australia, including in the United States and other countries where our technology providers operate. The countries involved can change as providers update their systems. Before disclosing personal information overseas, we take reasonable steps appropriate to the circumstances to assess and manage privacy risk. You may contact us for current information about material overseas disclosures relevant to your information.

7. Direct marketing

We may send you information about Fenrow, trials, products or events where you have consented or where permitted by law. Marketing communications will identify Fenrow and provide a functional way to unsubscribe. You can opt out at any time; service and relationship communications may still be sent where necessary.

8. Storage, security and retention

We use reasonable administrative, technical and physical safeguards designed to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No internet transmission or storage system is completely secure.

We retain personal information only for as long as reasonably needed for the purposes described above, to maintain appropriate business and trial records, resolve disputes and meet legal obligations. We then take reasonable steps to delete or de-identify it.

If a data breach occurs, we will assess and respond to it and, where the Notifiable Data Breaches scheme applies, notify affected individuals and the Office of the Australian Information Commissioner as required.

9. Access and correction

You may ask to access personal information we hold about you or request that it be corrected. Contact us using the details below. We may need to verify your identity. If an exception permits us to refuse a request, we will explain our decision where required.

10. Complaints

If you have a privacy concern, please contact us with enough detail for us to investigate. We will acknowledge and respond within a reasonable time. If you are not satisfied and the Privacy Act applies, you may contact the Office of the Australian Information Commissioner.

11. Third-party websites

Our website may link to third-party websites. Their privacy practices are governed by their own policies, and we are not responsible for their content or handling of information.

12. Changes and contact

We may update this policy as our practices or legal obligations change. The effective date above shows the latest revision.

For privacy questions, requests or complaints, contact the Privacy Officer at Fenrow through our contact form. Please write “Privacy” in the message.
